In the bible, it's not right to have relations with a divorced woman. I have a sibling who is have a relation with a woman who left her partner and child to be with my brother. I am against his decision to be with her. But he says that the woman and her man at that time was "never married" and also have a child too. They never had a marriage ceremony. So does that mean she dont count as a divorced woman. Or does the same stamdard apply because they had a family? Please help. My sibling is denying.
It is a sin to have sex with ANYONE when unmarried. This is considered the sin of fornication. It doesn't matter that society considers it normal.

Having sex with with another person's spouse is a sin. This sin is called adultery. Unless the woman has an annulment, such as an annulment through the state or through her church, she is still married.

Your brother is guilty of fornication and adultery.

Next question: is premarital sex sin?
Yes. The Torah considers any sex outside of marriage to be a sin. In the age that the Torah was written, one of the ways you became married was to have consensual sex.

Marriage is a covenant. That is a solemn agreement between 2 or more parties with witnesses.

So if they never said vows to each other in front of witnesses, never signed a marriage license, or never agreed they were married in the sight of God and never told everyone they were a married couple (commonlaw) then they were NEVER MARRIED. She is not divorced.

End of story.

Do they have to make those vows in front of God? I mean, if they go to a courthouse and get married before a judge, does God count and bless that marriage?

Do you mean in front of God or in front of clergy? It's hard to consider something a Christian marriage if it's not in front of God. But a courthouse is still in front of God.

But I think a covenant can exist even without that kind of formal commitment. We can take on responsibilities without a formal action. Are you familiar with a common-law marriage?

I suspect that in most western countries legal marriage is a contract under civil law. Listen to the church minister when s/he says "By the power invested in me by the State, I pronounce you man and wife." The minister, pastor, priest or whatever does not have the authority on their own to marry a couple - they need a license issued by an appropriate government authority.

Neither of these prove that consensual sex = marriage in the Lord's eyes.

I'm not so sure. John 4:16-18

16 Jesus saith unto her, Go, call thy husband, and come hither.

17 The woman answered and said, I have no husband. Jesus said unto her, Thou hast well said, I have no husband:

18 For thou hast had five husbands; and he whom thou now hast is not thy husband: in that saidst thou truly.

18 For thou hast had five husbands; and he whom thou now hast is not thy husband: in that saidst thou truly.
This does not alter the meaning of the other two verses. Besides, it can very easily refer to 4 or 5 divorces. What's most unclear about the passage is whether she's on man #5 or man #6.
