"My God, my God, why have you forsaken me?" up until this moment Jesus believed himself one with GOD ....

Why did Jesus say "My God, my God, why has thou forsaken me?"

Well, for one, there is a big difference between making an assertion and asking a question. Secondly, Jesus was referencing Scripture as a fulfillment of prophecy (Psalms 22:1). Thirdly, Jesus also said these words as if it was you and me in His place saying these words. For He was taking on our sins and our punishment.

In fact, when we look at Psalms 22, we can see that the response to the first verse where the psalmist cries out the prophetic words, "Why have you forsaken me?" there is an answer in verse 24. Here's the answer to the question of Jesus, the question of the psalmist and the question of every person who has ever felt abandoned by the Father: For he (God the Father) has not despised or disdained the suffering of the afflicted one; he has not hidden his face from him but has listened to his cry for help.

Also, Jesus would also be aware of pieces of Scriptures like these, as well.

"For the LORD loves justice And does not forsake His godly ones; They are preserved forever."
(Psalms 37:28 NASB).

"Father, if You are willing, take away this cup from Me. Yet not My will, but Yours be done."

Yes, Jesus did not want this cup because it had all our sins in it. But seeing He knew there was no other way (while talking to the Father), He said, let your will be done.

So you believe the sins of the world where transferred into Jesus by the drinking of a liquid from a cup that night in the garden and I am saying the cup is symbolic of breaking the law the very thought of which caused his sweat to fall to the ground like drops of blood .....

Why would Jesus be afraid to drink from a cup of symbolism?
Why would He sweat great drops of blood if it was all a symbolic thing?
Surely He took on our sins that day within that cup within the Garden.

Think like a detective.
What does the evidence of the crime scene say?
It was a crime because He was God who is holy, just, and good and was willing to take on the impurity of our sins within His body so as to be our substitute.
