  • CF has always been a site that welcomes people from different backgrounds and beliefs to participate in discussion and even debate. That is the nature of its ministry. In view of recent events emotions are running very high. We need to remind people of some basic principles in debating on this site. We need to be civil when we express differences in opinion. No personal attacks. Avoid you, your statements. Don't characterize an entire political party with comparisons to Fascism or Communism or other extreme movements that committed atrocities. CF is not the place for broad brush or blanket statements about groups and political parties. Put the broad brushes and blankets away when you come to CF, better yet, put them in the incinerator. Debate had no place for them. We need to remember that people that commit acts of violence represent themselves or a small extreme faction.

And now...

Supreme Court will let Trump administration end program protecting 500K Cubans, Nicaraguans, Haitians and Venezuelans

[AIUI, the issue has not been decided, but the stay has been lifted while the courts work through it.]
It is important to note the following from the article: "The Biden administration created the programs to address the growing number of migrants arriving at the U.S.-Mexico border and said the protections promoted legal immigration."

"Created" is the key. No law was passed, and now we have a new president. If a Democrat becomes president, do you expect him or her to keep every program that the Trump administration created? We have a separation of powers in this country, and the Supreme Court has no authority to promote political agendas.

The law was passed in 1990.

In 1990, as part of the Immigration Act of 1990 ("IMMACT"), P.L. 101–649, Congress established a procedure by which the Attorney General may provide temporary protected status to immigrants in the United States who are temporarily unable to safely return to their home country because of ongoing armed conflict, an environmental disaster, or other extraordinary and temporary conditions.

Certainly it appears to be the prerogative of the Administration to determine what countries are eligible. But Biden did not create this status.

My point is that President Trump has every right and power to negate any program of the BIden administration that was not passed by law. The decisions as to which countries are left up to each administration, and any administration can make a change. This baloney "because it is Trump the courts need to decide" must stop.

You repeatedly assert that Biden's immigration policy broke the law. Do you know exactly what law or laws were broken? There are no doubt many things Biden shouldn't have done, but which of them were actually illegal?

Can they do so with the stroke of a pen, or must there be some sort of official determination that the conditions of war or disaster (that initiated the status) no longer apply?

The Supreme Court has the power and the duty to thwart agendas it finds to be unconstitutional. That is it's "Separate" power.

Okay. Yet the point of the post you are responding to is that Biden's actions were taken based on a law. As such, Trump is limited in his actions by the wording of the law that was used.

The decisions as to which countries are left up to each administration, and any administration can make a change. This baloney "because it is Trump the courts need to decide" must stop.

I've not seen a claim about "because it is Trump the courts need to decide." Just like Republicans when Biden took an action (or Obama), if those opposed to the action the President took believed it violated the law or the Constitution, they challenged the President's actions in court. The same is being done with Trump and it is the duty of the Federal Judiciary, under the Constitution, to decide those claims based on current US law and the Constitution. The only difference between Trump and other Presidents, at this juncture, is just how heavily Trump is attempting to govern by Executive Order.

In a news conference this morning, Mayor Ras Baraka said several agents with U.S. Immigration and Customs Enforcement ...

Newark mayor sues Trump’s NJ prosecutor Alina Habba over ‘false arrest’ at immigration jail [a later event]

Baraka’s federal lawsuit alleges that Habba falsely arrested, maliciously prosecuted and defamed the Democratic mayor.

Habba is President Donald Trump’s former personal defense lawyer, and his pick for interim U.S. attorney for the Garden State.

[Habba's office dropped charges against Baraka, but has pursued assault charges with Congresswoman McIver from that same incident.]

Members of Congress are legally permitted to enter ICE facilities without prior notice.

U.S. immigration agents rounded up undocumented migrants as well as American citizens in a raid of a Newark, New Jersey, worksite on Thursday that the city's mayor said involved detaining a military veteran and violations of the people's rights.

"In a raid of a business establishment in Newark, outside New York City, Immigration and Customs Enforcement (ICE) agents failed to produce a warrant as they detained "undocumented residents as well as citizens," [Mayor] Baraka said in a statement.

"One of the detainees is a U.S. military veteran who suffered the indignity of having the legitimacy of his military documentation questioned," Baraka said.

“Suffered the indignity of having his military documentation questioned”? Ok so they had to verify his documents? I’m curious how long that he had to wait for that. I mean they can usually pull up someone’s information pretty quickly these days. Usually in just a matter of minutes. Sounds like an exaggeration to me.

They kept stopping Republican members of Congress from inspecting border facilities or checking on the conditions of prisoners in the D.C. area. Where were you when that happened?

Per a later post, they did not verify his documents, they ignored them.
The owner said his manager tried to show his veteran's card, but the agents did not accept it.

I don't know how many times I have to repeat this. When you are given an order by a law enforcement officer please obey. If you think you have been wronged you can later complaint or sue. It is not proper to shove or hit an officer as Congresswoman McIver did, nor to disobey commands. The reason is that you may be putting the lives of people in danger. Law enforcement needs to keep a situation under control, you can tell them you will file a complaint if you wish but please obey.

Yes, obey, unless you are assaulting the center of the government, then fight like hell.

We'll see what a judge and jury think about the facts of the matter, but no I don't believe Congresscritters have any special rights in this regard.

There is no narrative, it's on video. She should get two to four years in prison.
