A federal appeals court has allowed a heartbeat-based Texas ban on abortion to remain in effect, rejecting the U.S. Department of Justice’s efforts to reinstate an injunction. Biden administration officials have pledged to ask the Supreme Court to reinstate an injunction.

The law allows for awards of at least $10,000 for successful lawsuits against those who perform or “aid and abet” illegal abortions. Women seeking abortions cannot be sued under the law, which first took effect Sept. 1.

Why do you say that it's bad law?
It's an attempt to circumvent the supremacy clause of the constitution and it's wide open to abuse/vexatious litigation.

Why do you say that it's bad law?
Because it is a vigilante law that see individuals able to target individuals/organisations that they even suspect of breaking the law regardless of standing. With the case unfairly weighed in favour of the accuser.

Pity the child rape victim, or any rape victim for that matter, who finds that the rights of the paedophiles sperm and the resulting fetus takes precedence over their right to consent to what happens to their own body.

I don't see anything in the U.S. Constitution, which limits the right of the individual to sue for an illegal act.

I've read over the limited and enumerated powers that the People and the States have delegated to the Federal Government; and I just don't see this enumerated.

Can you point out where in the Constitution that the People and the States ceded their rights to seek action against illegal activity?

I don't see anything in the U.S. Constitution, which limits the right of the individual to sue for an illegal act.

It's an attempt to ignore the Supreme Court ruling in Roe Vs Wade. Please stop playing dumb.

Due process? Sorry talking about due process and the legal atrocity that is the Texas bill is absurd. It is a billl that allows anyone anywhere to sue anyone who they even suspect of noncompliance and not have to pay the defendants legal expense if they lose. It is a bill that allows multiple law suits against the same defendant using the same evidence but it refuses to allow courts to recognise legal precedence, as in if an accuser loses against a defendant, the other cases based on the same evidence are unaffected.

It is a vigilante bill.

Yes, due process. The fact is that these cases have to be tried in court, which is the antithesis of vigilantism.

Are you suggesting that I should be denied my day in court, that we should have elites which are immune to lawsuits? Oh wait, Obama's 'Monsanto Protect Act' already started cutting that branch off of the tree of liberty.

Take a moment read about the subject. 6 weeks is to short for there to be even the opportunity, since organising an abortion takes weeks.

You have not even read my post. It is a day in court where the state has rigged the system in favour of the plaintiff, that allows the defendant to be prosecuted multiple times using the same evidence with ever increasing costs.

Sorry but that is not due process.

This sympathy is one sided. It’s unfortunate that some believe it’s better to kill the innocent child rather than inconvenience the expecting mother.

I don’t know where your getting your information from but here in Dallas area it takes less than a week.

Anybody can sue anybody for anything. Do you not trust the courts to serve justice?
Clearly the writers of the bill disagree with you. As if one accuser loses a case, a thousand others can using the same evidence and the judges are barred from dismissing them because the first case lost, unlike other lawsuits. So the defendant who has been cleared by the first court will be bankrupted by the others all using the same evidence.
