I personally would fine her for being a public nuisance, and another fine for having her dog off the leash, and put her on a good behaviour bond for racial vilification.

I don’t know the laws in their area but she definitely deserves more than a slap on the hand.

If this gentleman had prior law infractions but was legitimately trying to clean up his life any encounters with the police could have devastating consequences.

What she did is close to a hate crime...... she wanted to call police and make the situation seem worse than it was because she believed the police would rough the guy up because of his race.

She wanted the guy to face harm and tried to increase the harm he would receive, by saying that a man was threatening a women....... and if that wasn't enough, an African American man threatening a white woman. And she didn't care whether or not the guy would have been beaten up or killed.

It is God's law that you reap what you sow.

But I personally would choose to forgive.

No not in this case. We saw what happened. It should be somewhere in between imo. A year in jail is ridiculous. If it comes to this, a lot of people are going to be in jail for just verbally losing their cool, freaking out and calling the cops. Happens all the time. I know. My sister worked in law enforcement.

Maybe some community service at an appropriate setting where she can actually learn something. The woman could have anxiety/panic disorder, whatever. Everything needs to be considered before just putting her into an already overburdened system. Same should apply to all. We got people running the streets with an obscene list offenses that should be in jail. A chick loses it in the park with a black guy and we are ready to send her up for a year.

First a year in jail is ridiculous and doesn't teach her anything. How about community service in a soup kitchen in a prominently black neighbourhood.

Secondly, why was he filming her? You can see right away that his filming angered her. Perhaps this triggered something in her because strangers can't know what issues other people have. Why can't people learn to get along without purposely trying to spark each other off?
You ask for the dog to be put on a leash -the person should apologise and leash their dog. This is what would happen if people were raised with any kind of manners and common decency, but no she's a racist and he keeps filming. I get he feels the need to but maybe he could have made it less obvious after she first goes off.

He filmed her so he would have visual proof that he had not threatened her. She tried to weaponize the police . He recorded the incident for his safety.

Maybe if people learn that there is a penalty for filing a false report, it will put a stop to the practice. It is happening too frequently lately.

I'm not that bothered by the filing of the false claim. It is the fact that this woman knows that the police has a history of violence against black people, and she used this knowledge to threathen the man, and followed through with her threat knowing that this could get the black man killed and destroy the lives of the man's family , the cop and the cops family.

And this lady would have gotten off scott free and watched the destruction of two families, had there not been a recording of her actions........

This is not something that should be taken lightly.

Anyone should be able to see that this is more that getting angry and filing a false claim..... this is akin to waving a gun around everytime you get angry...... this is not normal behavior.....

I personally find the above is the most circumspect comment thus far.

Without finding out exactly what happened, and what motivated each of the parties involved to act in the way they did, it is hard to judge.

However, if she allowed the dog to run off the leash in an on-leash area, she is guilty of contravening an ordinance and she should be penalised appropriately. That is cut and dried.

If it was in an allowable off-leash area and the dog was being a nuisance and annoying or threatening the welfare of humans and animals, and she refused to respond to a reasonable request to control her dog, then she is in breach of her duty of care to others, and is being a public nuisance.

In respect of what appears to be an intended racial rant, unless she has a history of this then in my opinion it may be unjust to sentence her to jail up front. What may be more appropriate is to sound a warning to her and anyone else that might react in similar fashion in a similar circumstance, that it is unacceptable to use a person’s skin colour or nationality in levelling an accusation (as against providing a description of the perpetrator of a threat or crime). She therefore should be placed on a good behaviour bond and if she breaches that with a racial slur then the original impost/penalty will be automatically applied plus the penalty for her re-offence.

The woman was justified in calling the cops because, at least according to her, the black guy threatened her dog and she felt intimidated by that. The bar is really high for a false report conviction. Prosecutors are reaching on this one.

Filing false reports has always been a crime in this country as it wastes the states time and money to investigate. The penalty is a deterrent to filing a false report so yes she should be charged under the law accordingly, if she is found guilty of actually committing a crime.

So the black man didn't really threaten the white woman by telling her "she wasn't going to like what he was going to do to her" and proceeded to reach in his pockets?

I don’t understand why we have to use ‘black’ and ‘white’ terms, why can’t we just say a man and a woman....if the woman involved had said ‘a man threatened her’, none of us would be having this conversation!

I don't understand either. Perhaps we live in a balkanized society and there's no turning back and maybe she was trying to describe the person to the police by using the word black man. These phrases were used in the article. Nobody took issue with that. Those threatening words were by his own admission used. Perhaps she took it as a threat(?) Why wouldn't she. I know I would never dream about getting away with saying something like this, especially if I were male and the other person was a female. This is was an awful disagreement that escalated because she didn't know what he meant by "I'm going to do what I want now" and then called her dog over after the dispute.
