Suing another Christian because of a fall. Should I do it or not?

If you took pics with a digital camera then it will have meta data stored in each file. This will have the date and time in it. Easy to print out with the picture.

As for the claim, get you solicitor to send them a letter stating the costs that need paying or you are taking it to court.

In the UK the business must fill out an accident report by law.
You also have no idea whether you will have an ongoing problem with your breathing, your sinuses, head, back, etc

I would write a full report, signed delivery, and send to the business, and await their reply. If it was to my satisfaction, that would be the end. If not, sue them.

But be careful you have no hidden injury or trauma.

Never sued anyone before till now. I fall in a restaurant parking lot because of a pot hole filled with ice. Fall on my face and broke my nose and went too the hospital ER. The restaurant is being sold by real estate and is not being kept up on maintenance so the parking lot has many pot holes. They are selling the building and parking lot mainly for the land so the building will be torn down. Do I have too sue the owner's or the insurance company? Will I have too go to court? I just want my medical bill paid which will be 1500 or more dollars.

No. Do not sue. Turn the other cheek and pay the bill. Suing is not in the spirit of Christ.

I find it quite noble of you, to only want your medical bills paid. Most would want a lot more than that, and would/can get it easily. If you only want medical bills......you should have no problem contacting the the insurance company and they will rush to have you sign off on that and agree to ask for no more in the future.

If you want more than that....the lawyer would be the best option. Give them the details, wait 1-3 years.....they will call you with the check. You dont have to worry about them taking money that would be for medical bills.....they will make sure that there is enough to cover the bills after their 1/3 is taken out.

And it will be unlikely that a lawyer will take your case if you demand that they only ask for bill + their 1/3rd. It would not be worth their time.......They would just help you set up small claims to handle it yourself......and you would win.

Many creditors have a right to place a lien on your property without filing a lawsuit. Here are examples of other types of property liens:

You should never make false claims against anyone, but it sounds like you were not
at fault and their insurance is liable for lack of maintenance and upkeep. Many properties
have liens placed against the money gained in a sale and it is as normal as apple pie.
Liens are used to pay unpaid electric bills, unpaid snow shoveling.....anything.

I disagree. While a suit in this case might be filed against the business in name, it is really a suit against the insurance company. You aren't out to get rich, you simply want recompense for your damages.

For those who say don't sue, it sounds like this was caused by the condition of the parking lot. If you don't sue what impetus does the owner have to make repairs? Some other innocent person could get hurt, perhaps worse than you were hurt.

Whatever happened to good old communication with the manager/owner of the place. Be level headed, take a witness and explain that you want compensation for the medical bill.

I don't think you should sue them. But I think if you still want them to pay the bill you should talk with the owner privately. Right before the above passage Paul talks about being able to judge between yourselves. Plus there is the whole idea that sueing people because you slipped on ice in their parking lot is kind of a new thing. I'm sure back in the day you would've just had to be more careful next time.

Before this escalated, the OP should have stepped up and communicated with the manager/owner to see if they would be willing to compensate. We don't work for restoration anymore in this culture, it's easier to make a fuss and place blame on someone. By gum, we want justice regardless of the cost.

Again, the injury in question may be a lesson for OP.

But why would the owner pay anything out of pocket when he pays insurance to cover these types of things? When you get in a car accident and it is your fault.....do you tell them not to bother insurance.....you will pay thousands out of your pocket and take it as a lesson to yourself to drive better......or would you suggest use the insurance that you pay thousands for annually?

Are they refusing to pay the bill? I would think that you should be able to talk to them about it before resorting to a law suit.

If you own a home and a stranger falls in front of the gate and gets a 2k medical bill.....Would you agree to pay for it out of your savings.......or would you let the insurance work it out since this is the very reason you are forced to carry it?

I wouldnt even waste time in those matters.....I would pay someone else 1/3rd to handle it all for me (which of course is paid through the settlement). The only issue would be that the lawyer will want to get tens of thousands and not just the bills paid.....here in lies the spiritual dilemma.....is it ok/right to take more than what is absolutely necessary for billing expenses.

I see nothing wrong with what you are saying.......Do you/would you, take care of car accidents out of pocket, ignoring insurance, because you are a christian?
