House passes interstate concealed-carry gun bill



While the “Concealed Carry Reciprocity Act” alleviates stringent interstate gun laws, the legislation was conjoined with the Fix NICS Act, a bill introduced by a bipartisan group of senators in November, and designed to make the reporting requirements for the National Instant Background Check System (NCIS) more stringent.

Fix NICS penalizes federal agencies who fail to report criminal records and domestic violence records to the FBI. It also incentivizes states to regularly and accurately report criminal records to the bureau by allocating federal grants to states that comply.

The bill’s sponsors include John Cornyn, R-Texas, Chris Murphy, D-Conn., Tim Scott, R-S.C., and Richard Blumenthal, D-Conn., along with senators Orrin Hatch, R-Utah, Dianne Feinstein, D-Calif., Dean Heller, R-Nev., and Jeanne Shaheen, D-N.H.




Looks like the Fix NICS Act was the bargaining chip, and if John Cornyn and Dianne Feinstein are both on-board with something, it looks like it could have a good chance of passing.


I personally think this is a good trade off. I like the idea of my permit being honored everywhere (considering, CCW permit holders have a very low incident rate to begin with so we were never really a concern in the first place), and fixing a much needed hole in our NICS system pertaining to mental health data.

The bill passed the house, and had a bi-partisan Senate bill attached to it...let's hope this one passes.

..agree with you. CCW holders are much more likely to be responsible with their firearms, and have a current incident rate far below the average. I do wonder if there should be a uniform set of standards for CCW issuance, but I'm not entirely certain what the current system is, so I can't speak to that without more researching.

..agree with you. CCW holders are much more likely to be responsible with their firearms, and have a current incident rate far below the average. I do wonder if there should be a uniform set of standards for CCW issuance, but I'm not entirely certain what the current system is, so I can't speak to that without more researching.

Right now, there's basically uniformity through most states, and many states already have independent reciprocity agreements based on similar standards. There are a few outlier states where there are close to no standards (and I would argue that should probably be addressed).

For most states the standard is
1) Two background checks (one from ATF/FBI, one from the state)
2) In class training requirment ranging from 8-12 hours
3) Test on the law, live firing test
4) Finger printing

Currently, with my Ohio permit, I can go to most states, there are just a few holdouts that don't want to seem to honor anyone else's permits no matter how good the requirements are.

So much for "States' rights".

"States Rights" are kind of like "Fake News" or "Activist Judge". People avoid the terms when decisions are made they agree with, and use them when decisions are made they disagree with.

So much for "States' rights".

This is one of those things where both sides tend to have a double standard.

One side says it applies for marriage but not guns, the other side claims the inverse.

The reality is, concealed carry is a state issued license, and when courts ruled that FF&C clause of the constitution extended to state-licensed statuses, the precedent was set.

...plus there have been two SCOTUS rulings, one ruling that ownership is an individual (but not unlimited) right, the other claiming that banning CCW violates the first ruling (the Illinois case). Between the legal precedent on FF&C, and the two rulings, I would say this bill is the right call to make.

I just don't want to see people who honestly should not have access to ANY firearms for some reason to go "license shopping" in order to bypass well-thought out regulations. But that's tangential to this bill.

I would agree...however, that hasn't really been a point of issue.

The 11 million CCW holders in the US have a collective murder rate of 0.85 (to put that in perspective, that's lower than France, the UK, Australia, and Canada), so if there were a nation comprised only of the 11 million US CCW holders, it'd be one of the safest countries on the planet.

Not saying this to trot out the whole "good guys with a gun save the world" speeches...just more or less a reflection of how CCW holders tend to be generally safe.

That being said, there's not statistical reason to suggest that I, as an Ohio CCW holder, present any safety risks to the state of New York if I were to travel there.

About time! I hope they manage to get this through. Isn't it amazing what we can do when we compromise like our government was designed to?

The only thing I'm concerned about are perhaps some of the other senators who may feel the need to oppose it based on trying to appeal to the people who say "Nope, we can't give an inch".

I thought the gun owning community would be overwhelmingly behind this move, however, I was pretty surprised at some of the reactions I was seeing on social media. There were some far right people who were pretty hot about it and not only view the move as "selling out to the democrats", but some even went as far as saying that they were going to cancel their NRA memberships due to Wayne L. backing this bill as well.

Yes, that is the hyper partisanship we have come to know and love. Heaven forbid we look at each other like reasonable people with differing viewpoints rather then the enemy who is out to destroy the country. :(

I would like to couple this law with closing the loopholes that allow sales at gunshows without background checks and the same with internet sales, and I would also like to see a ban on those things that make guns into full automatics. I think that would be a reasonable compromise.

It seems to only matter when conservatives dont want Some freedom allowed in their state.

Well, like I touched on before...it's not fair to only highlight the conservatives on that topic as both sides tend to do it.
