Trucker convoy demands arrest of congressmen who disobeyed oath


[UPDATE OCTOBER 8, 2013 - Ride for the Constitution has issued a stern disavowal of some of Mr. Conlon's remarks to US News and World Report, and affirms that he is not a spokesperson for the organization. Ride for the Constitution disassociates itself from anyone contemplating "breaking the law." The statement takes US News and World Report to task for omitting the "core message" of the protest, the Constitutional issues involved. This writer has attempted to treat these in some depth. An organizer of this weekend's truckers Ride for the Constitution has called for the arrest of congressmen who voted for what the truckers say is unconstitutional legislation, in violation of their oath of office to defend the US Constitution. Listed in a press release entitled "terms" at their website are objections to the recently-passed NDAA, which authorizes the indefinite military detention of US citizens without charge or trial, to violations of Fourth Amendment guarantees against unreasonable search perpetrated by the TSA, and to the creation of the Department of Homeland Security, which without a foreign mission, the truckers say constitutes a "standing army."

NDAA roll call vote 2012 Organizers of the ride are asking Americans in support of the convoy to buy nothing between October 11 - 13, the dates of the convoy to DC, in order to show support. Truckers say they will ride the beltway around the capitol and "shut down" DC until the congressmen obey their oaths. They ask supporters to write #t2sda on their windshields and on signs ('truckers to Shut Down America.')

In an interview with US News and World Report, organizer Earl Conlon said: "we're asking for the arrest of everyone in government who has violated their oath of office."'

Although in the US News and World report Mr. Conlon said that if constitutionally bound officers did not execute the arrests, he would do it himself, the group issued a statement on its official Facebook page in a rebuke to Mr. Conlon, saying that there were no plans to effect any arrests themselves, and that the convoy was committed to being entirely peaceful. Calls for arrest were to be limited to calling on constitutionally-bound officers to do their duty.

The "terms" at RideForTheConstitution.org, the official website, read, after addressing trucker-specific issues:

1) The National Defense Authorization Act is unconstitutional. It allows for the military to “disappear” any American Citizen without charge or reason. It allows the military to take control of all private industry. And it ends the “Posse Comitatus”, which protects American Citizens from being fired upon by our own military.

2) The Affordable Care Act is unconstitutional. It forces American Citizens to either, purchase government operated healthcare for their profit, with choice of treatment to be given, if any, or be fined by taxation without representation, for not participating. It also uses tax dollars to provide health care for illegal immigrants, free of charge.

3) The Department Of Homeland Security is a non-military security force, which is violating the Constitution by using tax money to build a standing army, on American soil training to engage with the American People.

4) The Transportation Security Administration not only violates the fourth amendment, they believe it gives TSA Agents the right to commit crimes of Sexual Misconduct, breaking the law in all 50 states.
The NDAA, the acronym for the National Defense Authorization Act passed by Congress and signed by Obama for the first time in December 2011, authorizes the arrest and military detention of US citizens without charge or trial upon suspicion of having "substantially supported al-Qaeda, the Taliban, or associated forces," and "any person who has committed a belligerent act." The act allows citizens to be held indefinitely, in secret.

The NDAA was passed despite concerted call campaigns to Congress and the subsequent formation of citizens groups to oppose it, by enacting state-level legislation commonly known as "NDAA nullification," which directs local and state authorities to not cooperate with federal authorities acting under the law. So far California, Oklahoma, Alaska, Virginia, South Carolina, Pennsylvania, Michigan, and Massachusetts have passed or are considering some form of "anti-NDAA" legislation.

Opponents of the NDAA argue that the right to a jury trial of peers when accused of a crime is an iron-clad, guaranteed right of all American citizens, under the Sixth Amendment of the Constitution. Ironically, Mr. Conlon has called for the arrest and trial for treason of Mr. Obama under treason laws, for siding with and pushing for US military action on behalf of rebels in Syria, Many analysts say that the rebels are dominated by what the language in the NDAA would describe as "associated forces" of "Al Qaeda."

Regarding the Department of Homeland Security and the TSA, the latter of which is an arm of DHS, opponents claim that the departments are accumulating weapons of war, and engaging in "unreasonable" searches of the American people in violation of the Fourth Amendment. The truckers worry that both could easily be transformed into a tyrannical force employed for domestic reppression, along with regular US military forces unhindered by the Posse Comitatus Act. Posse Comitatus previously prohibited regular military from engaging in domestic law enforcement. The Act's prohibitions have been steadily eroded by a string of legislation since 9/11. in recent years a series of military drills involving Black Hawk helicopters have been unleashed over US cities, usually captured by amateur videographers.

in addition, critics of the Obama administration have complained of the increase in thousands of public searches, not related to any threat, by the TSA’s Visible Intermodal Prevention and Response task force–or VIPR. Organized into mobile SWAT teams, the interagency federal authorities arrive at train and bus stations to execute searches of everyone on the premises, such as the Georgia Amtrac Station in 2011, in which all travelers, both entering and leaving the station, children and adults, were patted down.

One popular blogger
claims that that such operations are "classic B.F. Skinner-style" behavior modification "on the People of the United States of America." The blogger says:
"it casts a spell over us, to break down our internal sense of popular sovereignty and to make us believe on a subliminal level that we are subject to government. Effectively, we prove that point to ourselves by obeying and being sharply humiliated..."
The truckers state in a flyer made for distribution:

"If we want to save our country, we will do so. If we don’t, it will be because you as an individual wanted someone else to save it for you — this is why we are in this mess — because we trusted someone better dressed, smarter, richer, better educated or more experienced. Look where that has gotten us. It’s time for each of us to say enough is enough & show them who runs this country. Let’s make them panic by getting off the couch."

If I recall correctly there are some very specific protections from arrest that apply to sitting Congressmen.

There is no constitutional grounds for the arrests these fools want, but there are very likely constitutional grounds that prevent it.

There's some argument as to who actually represents this group anyway. They also claimed that they wanted Obama impeached and removed from office.

Ridiculous bid for attention, and they seem to be getting it, too.

Without the truckers the country would starve in a few weeks.

That's a bit of a hyperbole. But even so, there are still all the other forms of transporting goods, as well as all the truckers who don't support this movement. And those that may support the movement but don't want to go without pay for however long. The impact would be minimal.

And if every Trucker out there was swept up to Heaven in a Whirlwind they could be replaced within days.

There are probably more people out that who at one time heal a license for heavy trucks than there are active truckers by a considerable margin. And driving a truck is not rocket science. It wasn't that hard 40 years ago and advances have made it easier.

I hope they shut down dc and make like there unbearable for a few days. The things they speak about are legit threats to americans, and much more so than the boogey man taliban hiding out it caves half the world away.

Kinda hard to shut down DC with only a few trucks. So much for their conviction. Had they stayed away from the crazy stuff, I bet more truckers would've shown up. But, people knew better than to be associated with yet another nutter group.

Attempt to get demands met by throwing public temper tantrum inconveniencing people who are in no way responsible for the grievances they want redressed, check.
