Well, yes the parties have changed greatly (which is why I'm no longer Republican.) IMO-- the democratic party has been stolen by socialists (now using the term progressives so they are better accepted)
However, I still think today's Republican party stands for the littler guy, minorities, small businesses etc., in general.

In the American system which is, often, at best, a compromise, the three branches are "co-equal". The right to determine the constituionality of any given legislation provided by Congress rests solely with the Supreme Court (Marbury v Madison)
That's their "power". It is a check/balance to the Legislative overreach.
This is not say there isn't judicial activism at all. But it is far too loosely used in the US when people see court decisions they don't personally like.

Maybe the leftists you hang with are more delusional than the ones I do, but I never heard anyone say that Bush the Lesser would seize power. I heard a lot of that when Bush was re-elected. I remember him being called a dictator, lier, fascist, and even the anti-christ. I heard far worse about Bush than I have about Obama. Apparently it's okay for some people to talk about how they wanted Bush to be assassinated, yet anyone who questions Obama or his policies is automatically a nutcase or a racist.
