HAYDEN, Idaho – A Kootenai County Sheriff’s deputy is being praised for a small act of kindness.

Deputy Matthew Brakeman pulled over a woman in Hayden who was speeding a couple weeks ago, but instead of giving her a ticket he offered up something else. Brakeman said the woman was going about 10 miles over the speed limit.

"Driver was not happy to be stopped. So I spoke to her for a moment," said Brakeman.

When he started talking to the driver he could tell something was different. In the passenger's seat was the driver's mother.

"I asked where they were headed. And she said to the oncologist. She then started to become a little bit emotional," said Brakeman.

He learned the driver's mother had been battling cancer. They were on their way to another painful trip to the doctor's office. Brakeman went back to his patrol car to collect his thoughts. He knew something more powerful than a ticket was needed here.

On the woman's Facebook page she said "Needless to say, I emotionally lost it. I don't know the officer's name that stopped me, but I want to thank him for his blessings and for hope."

It's okay to give a warning instead of a ticket, as long as the speed limit wasn't completely blown away.

It is also okay to offer a prayer to the people, but if the people in the car decline, there should be no prayer, and still a warning instead of a ticket.

In short, good on those officers, as long as they don't start preaching to a captive audience.

Hard-hearted as I am(?), I'll say that a relative (or even yourself) having cancer is no reason or excuse for putting other people at risk by driving at excessive speeds.

A ticket it should have been.
With prayer if you wish.
But the ticket, definitely.

10 over isn't necessarily putting people at risk. It's not even necessarily excessive speed. Our sheriffs routinely use warnings for violations between 7 and 10 over.

UK, that will depend on the limit. 10 over on 70, not so bad. 10 over on 30. Dangerous and likely to get fixed penalty notice.

But I'm still chewing over the idea that "troubles" is an excuse for illegal behaviour, though I've long noted an odd skewing of the public's view of motoring law-breaking compared to other crimes.

Vehicle code is a revenue scheme, there is little evidence that randomly enforcing it does anything to make anyone safer, there is strong evidence to support that the state is raking down big bucks off of it.

For 10 over, no, a ticket is not automatic.

Nothing wrong with a little compassion for the circumstances.

I have a long commute to work and I have noticed in the last several years, traffic moves slower than it used to and it is not unusual, for people to be going below the speed limit. When I get behind a slow driver and eventually pass them, they typically have their phone in their hands and are texting and trying to drive at the same time.

In general, I would agree.

To me, the biggest risk on the roads today, is people using their phones when they drive. I have a long commute to work and I have noticed in the last several years, traffic moves slower than it used to and it is not unusual, for people to be going below the speed limit. When I get behind a slow driver and eventually pass them, they typically have their phone in their hands and are texting and trying to drive at the same time.
Texting/talking on the phone was only made illegal in my state a short time ago. I do abide by the law in this respect, because i know only too well from driving behind a person who is on the phone just how dangerous they can be. The only time I speed is when the flow of traffic is going at the same speed.

The worst story I heard was from my husband. On his motorbike one day, he passed a driver who was weaving, and had almost taken him out once by braking suddenly. When he drew level, he looked in and saw that she had her iPad on her steering wheel and was playing a game as she drove. :O Such drivers are a real danger. When I see someone weaving, I get around and past them asap.

When one is upset about something like this and going to a doctor's appointment, it's not an excuse to speed, BUT.....it would be easy to do unintentionally. Why make what is already an exceedingly difficult time harder, and an added expense, if it really isn't necessarily. A warning seems to be appropriate to me.

I was 23 and the people at the urgent care hadn't wanted to scare me so they simply told me to go the ER and that docs would be waiting for me. Because the police officer who pulled me over knew from the scanners that I was coming in, he wasn't about to give me a ticket. These days I wouldn't drive 55, but I would be driving as fast as I thought I might be able to get away with, since an ambulance ride would take twice as long.

My oldest son's first trip to the ER got me pulled over for doing 55 in a 35, and then got me a police escort the rest of the way. I was 23 and the people at the urgent care hadn't wanted to scare me so they simply told me to go the ER and that docs would be waiting for me. Because the police officer who pulled me over knew from the scanners that I was coming in, he wasn't about to give me a ticket. These days I wouldn't drive 55, but I would be driving as fast as I thought I might be able to get away with, since an ambulance ride would take twice as long.
You cant think about things like that when you kid is in trouble. My youngest daughter went down the sliding board with a stick in her mouth, you can imagine the injury. We topped 100 numerous times as it is 30 minutes to hospital and I could not stop the bleeding, we made the hospital in 12 minutes, fortunately no cops that day.

And in my experience most people didn't go the speed limit in Idaho, though the roads were empty enough it wasn't really an issue.

Well, yeah, good point. I mean, around here normal speed in a 55 is 62. So 65 isn't much of a stretch!
