Due to restrictions on AP stories I can't post enough
of this story to shine some light on it.

The short of it:

car hit cyclist, car was doing over 100mph in a 55mph zone. Cyclist did not have any reflectors on the bike or rider after dark. Court found both at fault.

for the life of the 17 yr old the insurance paid $48k.
The driver is suing to recover the cost for his car.
$29k.

It doesn't say if the driver recieved anything for the
his vehicle damage.

I saw this and wish I found it hard to believe. Instead, I find it incredibly sad that someone cannot own up to his responsibility in the death of another person.

As for his damages, if he agrees to pay appropriate damages for the death of the young man (perhaps what his earnings might have been for his lifetime, along with pain and suffering money for the young man's family?), I would have no problem with the man collecting the money to fix his car. Since I don't see him willing to agree, I think his case should be kicked out of court and he should be charged court costs.
