The SC upheld Obamacare this morning. In particular, it upheld the mandate on a basis of taxation. Obama had insisted the mandate was not a tax, but when his lawyers argued its validity that is exactly the basis they used to justify it.
Whether today's ruling makes constitutional sense, I don’t know, though it seems sleight-of-handish to me. But the issue now is tossed to the electorate. And frankly, that's a better place for it to be resolved, because obamacare was rammed down the throats of the majority of Americans.
If you consider the numbers – almost 2/3 want the bill repealed, and most of them strongly so – I believe today's win is a pyrrhic victory for Obama. Romney is going to come out strongly condemning obamacare, and the issue now has become the centerpiece of the campaign, especially as it ties in with Obama's non-record on jobs, as he squandered political capital on his health care scheme.
I believe it's better that the law get struck down by the electorate than by our nine robed masters, because in doing so we will have a national conversation on our health system, one ending in an actual vote. I don’t know what to expect from this nation any longer, but I want to believe this law will indeed be repealed.
All Obama has to do is keep pointing out that Romney flips on everything he says so why would we trust him to repeal something he did in his own state as Governor?

The ruling helps Romney in that he has something to run against instead of coming up with his own plan. Although he is really runnhing against his own plan since his state plan was bacsically the same thing. That's why I call it ObamaRomneyCare.
