Justified how?

Following the logic behind the death penalty, Saul of Tarsus should have been convicted and executed as a murderer of innocent Christians long before he ever got the chance to become St. Paul, the venerated apostle of the gentiles.

That's not to say that there aren't irredeemable killers out there, people so twisted that they will never cease to pose a threat to the well-being of innocents - but that's what prisons are for: to contain such people. It just won't do to stoop to the level of murderers in the name of revenge.

Besides, the death penalty does not serve as a deterrent, or else we would detect a significant rise in murder cases whenever a country abolishes it. As it is, most developed countries have long since abandoned the practice, yet it did not result in violent crime sprees.

And from what I've heard, it's not even as if death row inmates would weigh LESS heavily on the tax payers purse, just in case someone wants to talk economics. If memory serves, the death penalty is considerably more expensive than a life sentence.

Theoreticly, I think the death penelty is a good idea. But the theory breaks down in practice. A small but significant number of police officers make bad arrests based on "gut" instincts. Detectives don't do their jobs. Crime labs fudge evidence. Prosicuters prosicute for political advantage. Only the rich can afford tallented lawyers. Juries rely on predjudice over fact. The list goes on an on. Today, in America, it is truly a frightening thing for an innocent man to fall into the hands of the law.

Until and unless guilt can be absolutly proven, the death penelty should be shelved.

As mentioned, it doesn't seem to act as much of a deterrent.

Furthermore, there are already deterrents. Life in prison, for example. If somebody isn't deterred by that, chances are they won't be deterred by the death penalty, either. The sorts of crimes that warrant the death penalty aren't usually done by the sort of criminal who weighs the consequences.
