US Patent Application 20090010962 - Genetically Engineered Swine Influenza Virus
The present invention relates, in general, to attenuated swine influenza viruses having an impaired ability to antagonize the interferon (IFN) response, and the use of such attenuated viruses in vaccine and pharmaceutical formulations. In particular, the invention relates to attenuated swine influenza viruses having modifications to a swine NS1 gene that diminish or eliminate the ability of the NS1 gene product to antagonize the cellular IFN response. These viruses replicate in vivo, but demonstrate decreased replication, virulence and increased attenuation, and therefore are well suited for use in live virus vaccines, and pharmaceutical formulations. This seems altruistic, but the application was filed in June of 2005. A vaccine wasn't necessary until 2009. See link for further details.

Curiously enough, a full year before any reported case of the current alleged H1N1, the major pharmaceutical company, Baxter, filed for a patent for H1N1 vaccine: Baxter Vaccine Patent Application US 2009/0060950 A1. Their application states, "the composition or vaccine comprises more than one antigen.....such as influenza A and influenza B in particular selected from of one or more of the human H1N1, H2N2, H3N2, H5N1, H7N7, H1N2, H9N2, H7N2, H7N3, H10N7 subtypes, of the pig flu H1N1, H1N2, H3N1 and H3N2 subtypes, of the dog or horse flu H7N7, H3N8 subtypes or of the avian H5N1, H7N2, H1N7, H7N3, H13N6, H5N9, H11N6, H3N8, H9N2, H5N2, H4N8, H10N7, H2N2, H8N4, H14N5, H6N5, H12N5 subtypes."

As far as I can tell, they were working on a vaccine for a major number of possible flus, of which the swine flu was one of them. Now comes the matter should a vaccine, or medication in general, be patentable?

H1N1 has been around.....forever. Remember the 1918 Flu was H1N1.

Like most conspiracy <staff edit> this is largely based on ignorance.
The H1N1 virus has been around since at least 1918 and if I had to bet I would say it evolved before humans ever walked the planet. Inflenza by it's very nature jumps from host to host swapping genetic information with other influenza strains. This is why we have a hybrid swine and bird flu right now and shifts like this have been happening for thousands of years before genetic engineering.
Another glaring fact to point out is that we didn't have a vaccine for this specific strain of influenza. The entire point of the vaccine is to get as close a genetic match as possible and this vaccine is tailormade to the strains that are projected to effect us the most. This year the only reason we have as much as we do is the evil vaccine manufacturers finished their batch of regular flu shots early.
The vaccine takes about 9 months to make, 3 months of research and 6 months of production. With H1N1 the 3 months of research was shaved off the top since it was one strain and we knew exactly what to expect.
See what I mean, conspiracy theories don't sound all that plausible <staff edit>.

If they were going to artificially create a virus, then spread it, killing thousands, in order to rake in money from the vaccine, why on earth would they file a patent the likes of which could be found by you or I?
Whoever is doing this is supposed to be a homicidal mastermind, creating new pandemics in order to make billions years down the line, but at the same time they show the same level of ability to clean up their tracks as a five year old stuffing soiled sheets into a washing machine that they don't know how to operate.
Sometimes occam's razor really does win out you know, even if it is the more boring explanation.
