State's Attorney for Baltimore City Patricia Jessamy: STATEMENT OF STATE’S ATTORNEYS OFFICE FOR BALTIMORE CITY RELATIVE TO THE ALLEGED BALTIMORE ACORN INCIDENT Baltimore, MD – September 11, 2009 – We have received inquiries from citizens and the media asking whether the Baltimore City State’s Attorneys Office would initiate a criminal investigation for acts allegedly committed at ACORN offices located in Baltimore. The only information received in reference to this alleged criminal behavior was a YouTube video. Upon review by this office, the video appears to be incomplete. In addition, the audio portion could possibly have been obtained in violation of Maryland Law, Annotated Code of Maryland Courts and Judicial Proceedings Article §10-402, which requires two party consent. If it is determined that the audio portion now being heard on YouTube was illegally obtained, it is also illegal under Maryland Law to willfully use or willfully disclose the content of said audio. The penalty for the unlawful interception, disclosure or use of it is a felony punishable up to 5 years.

Now, Patricia Coats Jessamy, the Baltimore City State’s Attorney, is trying to silence those who have broadcast the video footage, relying on a Maryland law that violates the First Amendment. She is not interested in prosecuting the crimes recorded on the video, such as promoting “ sex slavery.” Instead, this partisan, ardent Obama supporter wants to prosecute those who took the undercover video — and those citizens, bloggers, and journalists who broadcast it or “use” or “disclose the content” of it!
In her public statement turning a blind eye to ACORN’s crimes, she complains that the video may “possibly have been obtained in violation of Maryland Law . . . Article §10-402, which requires two party consent. If it is determined that the audio portion now being heard on YouTube was illegally obtained, it is also illegal under Maryland Law to willfully use or willfully disclose the content of said audio. They were successful at giving ACORN a big, black eye. I believe that was their goal.
It is clear that ACORN needs to get its act together or be disbanded.
If the filmmakers broke Maryland's wiretap laws, they should be considered for prosecution. You can't violate laws even if your motives are honorable.

Hmmm... if someone is trying to silence the video by censoring it, then s/he is being a huge idiot. Censoring something online normally only has one effect... massive spreading of that item.

I'll bet there are TV stations that did undercover investigations in Maryland. Should they be charged?

Would you want someone to be able to bring a camera into your home and tape you without your permission?
Most states have laws requiring businesses or other individuals conducting audio or video surveillance to post notices. That's why you see so many signs like VIDEOTAPING IN PROGRESS TO DISCOURAGE SHOPLIFTING or YOUR PICTURE AND VOICE MAY BE RECORDED and so forth: those signs are there to comply with laws mandating disclosure of such recordings.
