What is really criminal is that web sites such as "The Daily Camera" and "Wikipedia" still carry such brazen unsubstantiated "facts" as "McKinney and Henderson plotted to pose as homosexuals and lure Shepherd ..." when the indisputable fact of the matter is the jury did not believe any of that.

That's irrelevant. The proposed defense did not depend on Wyoming having hate crime legislation relative to homosexual behavior. The defense had to have a reasonable basis in truth, and the judge, in pre-trial hearing, determined it did not. So your accusation does not stand. Like I said, he didn't believe it. McKinney "remembered" sexual abuse as a child (the alleged "flashback" event that caused the "panic") that had never been reported and had never before been an issue. In fact, in drug treatment previously, he pinpointed his addiction (by the way, he was high at the time of the murder) as being the result of being unaccepted and unpopular in high school. That became a matter of public record and was no longer covered under Part 42B of HIPA because he raised the issue as the potential defense to his crime, and cited his drug addiction as another mitigating factor.

If a kid like that were in my grade, it'd freak all of us out too. (all-boy's Jesuit school) We wouldn't kill him though. We'd insult him, bully him, make him cry, but not kill him.
