According to the reports I read (other sites linked into different coverage, of which the LA Times is the most complete), the alleged assailant is charged with murder and use of a firearm in a murder, that it will be prosecuted under California law as a hate crime, and that he "is likely to be" tried as an adult.
A classmate of the two said that the victim being openly gay and cross-dressing "freaked out" the alleged assailant.

I don't think teenagers really know what they are.
This is really sad if this is why the shooting occured.
Someone in this kids life, made him believe this is how to deal with gay people. And even worse, someone let a child have access to firearms without parental guidance.
I don't believe in hate crimes laws. I think laws should be based on actions, not ideas. Punishment should be more severe for reasons like this, but not special laws based on the thinking(or lack there of) of the crimianal.
Murder is murder, hate or love for the person killed doesn't change the result.

But one can argue that a hate crime does more than kill a person. It kills an innocent person and sends a threat to a specific group of people. That latter part means the crime is more serious than a normal murder. In my view, it's more akin to terrorism than murder.

If it were the other way around, people would sympathize with the culprit.
This bastard who shot the poor kid should be thrown in prison for life, yes. But, If a gay kid was harassed and decided to shoot a hetero, white male in the head there would be less venom directed towards the perp'.
