U.S. District Court Judge Richard M. Berman on Thursday nullified the four-game suspension given to New England Patriots quarterback Tom Brady by the NFL over the DeflateGate case.



At issue was whether NFL Commissioner Roger Goodell followed the rules set forth in the league’s collective bargaining agreement when he suspended Brady for four games and then upheld that suspension upon appeal. The league’s main argument was that Goodell had the right to punish Brady however he saw fit, based on the collective bargaining agreement, and that courts have long deferred to arbitrators when ruling on similar labor conflicts.

Lawyers from the NFLPA, representing Brady, contended that Brady’s punishment went above and beyond anything outlined in the collective bargaining agreement and that the league kept changing the reason why it punished Brady, initially claiming he had a “general awareness” of the plot to deflate footballs but then saying he had an active role in the scheme.

Interestingly, the Judge did not base his ruling on whether Brady had anything to do with the deflated balls. He ruled based on whether the Commissioner overstepped his authority in suspending Brady.

So this ruling does not mean Tom is innocent. Not by a long shot.

I think Brady should have been suspended 1-2 games just based on the "appearance of impropriety" aspect. That said, thank God I don't have to hear about it any more. Can we just play football?

It's called "circumstantial evidence". And it is fully admissible in a court of law. Not that Deflategate is a court case, but it does not make Mdoc a liar for coming to the conclusion based upon the circumstantial evidence.

agreed. the man is a professional quarterback, for heaven's sake.
He's got to know a football like the back of his hand; how it's shaped, what it's supposed to feel like, etc.
even if he didn't know about the footballs being deflated, he should have been able to recognize the difference
the minute he picked one of them up.

And so should the refs have noticed the difference in the feel of the football during the game.
they handle the ball before every single play, so why didn't one of them catch on?

i guess the question here is out of all the people that handled the footballs, why didn't someone
say something and stop the game?

we'll know someday just who was aware of what was happening--it will come out in the end.

Its not even circumstantial according to the Wells report, but just an opinion. They didn't even have conclusive evidence tha that balls went out onto the field after being inspected by the referees under inflated.

Of the twelve balls, only one was significantly under inflated, and that was the ball the Colts defender intercepted and they team had on the sideline for ten minutes before giving it over to the ref for review.

A DA would never bring a case against an accused based on merely being generally aware of the crime being committed by another person.

that is a really interesting standard of justice you have proposed there.....

In Brady's case it was just him who the investigator said that he was "probably" aware of the balls being deflated.

Even with the ball handlers, the investigator never found evidence proving they deflated the balls.

If they couldn't prove the handlers did anything, how can accuse Brady ?

the league had a stronger case against the patriots with spygate than with deflategate. the league should have done something more then.

Except in the so-called "spygate," Coach Belichick didn't hide anything. First off, he went to the NFL three times to complain about the NY Jets policy of having the visiting team coaching boxes, up on the same side of the field as the Jets. This gave the Jets the unfair advantage of looking down at the visiting team's sideline, where they could read lips and watching what players were being put in and out of the game. The NFL, per Roger Goodell, refused to do anything about it. The visiting team being on the same side of the field as the Jets, could not see the Jets sideline.

So, Belichick had video cameras set up on his side of the field where they could video the Jets sideline, and feed the coaches in the box. He did this in front of 80,000 people, so it was against the rules, but it did not give them an advantage over the Jets, who create the disadvantage for visiting teams.

Fact is, the NFL change the rules afterwards and teams most provide coaching boxes to the visiting team, on their own side of the field.

This was a civil case.

Brady and the NFL Players Union brought the lawsuit against the NFL.

The Judge threw out the entire punishment.

You brought up a DA. That would be criminal. I was saying you need to make the correct comparison in that.

I think Goodell needs to go. You know the story of King Midas where everything he touched turned to gold? Roger Goodell has the reverse of that.
